Australian Information Commissioner Urges Government Agencies to Strengthen Messaging App Policies

The Australian Information Commissioner has called on government agencies to improve information governance when using messaging apps, ensuring compliance with legislative obligations. A recent review of 22 agencies revealed that while messaging apps like Signal and WhatsApp are widely used for official communications, many lack adequate policies addressing privacy, freedom of information (FOI), and recordkeeping requirements.

Commissioner Elizabeth Tydd emphasised that while digital communication tools evolve, agencies must uphold transparency and accountability. The report found that 16 of 22 agencies permitted messaging apps, with 12 endorsing Signal, yet only half had policies governing their use. Critically, existing policies often failed to address FOI, privacy, and security concerns.

The report, the first of its kind under the Australian Information Commissioner Act 2010, highlights the need for stronger governance. Recommendations include developing clear policies, conducting due diligence on app features, and ensuring compliance with privacy laws. The Office of the Australian Information Commissioner (OAIC) collaborated with the National Archives of Australia, marking a co-regulatory milestone.

The Director-General of the National Archives welcomed the findings, noting their importance in guiding recordkeeping practices. The OAIC plans to revisit the issue in two years to assess progress.

As messaging apps (many with disappearing message functions) become entrenched in government work, the Commissioner’s recommendations aim to safeguard information integrity and public trust. Agencies must act to align digital practices with legal and democratic standards.
